Appellant, Binio, filed suit against appellee, Lake Ferry Resorts, a Florida Partnership, seeking back pay and severance pay under a written employment agreement.
The case was submitted on cross-motions for summary judgment. The trial judge granted the appellant’s motion for summary judgment, and denied appellee’s motion for summary judgment.
The agreement in question provided for severance pay to the appellant when he left his employment at Lake Ferry Resorts. According to the terms of the agreement, the appellant was to be paid in a lump sum $13,600, or if he left employment for other reasons, $3,200 per month for a period of twelve months, or a lump sum of $43,200.
The undisputed facts are as follows. Appellant Binio was employed as an executive vice president at Lake Ferry Resorts from January 1, 1978, to February 22, 1979. Appellee is a Florida partnership which operates a planned unit development called Lake Ferry Resort, consisting of a condominium.
On February 21, 1979, Binio was called to a meeting at the company office. He was told by a general manager of the development, Elton Ogawa, that he was being terminated. Ogawa gave Binio a verbal notice of termination and told him he would have severance pay. The $43,200 severance
